These terms and conditions govern the use of the website service at https://YOTEGUARDO.COM (hereinafter, the "Website"), which is made available to Internet users by YOTEGUARDO.COM (hereinafter, "YOTEGUARDO").
These terms apply to all authorized addresses provided by YOTEGUARDO for accessing the Website.
Any operations or transactions carried out through the Website shall be considered to have taken place in Spain and shall be formalized in the Spanish language, governed by Spanish law, these terms, and any applicable specific conditions.
YOTEGUARDO is headquartered at Camino de Algarrobo SN, Vélez Málaga, 29700. All communications and complaints may be directed to the aforementioned address or via email at soporte@yoteguardo.com.
The documentation is written in Spanish, and online purchases (e-commerce) are subject to Spanish law.
Using the Website grants the user (hereinafter, the "USER") the status of such and implies acceptance of all conditions set forth in these terms.
The provision of Website services is limited to the duration of the USER’s connection to the Website or to any of the services offered through it.
Therefore, the USER must carefully read these terms and conditions each time they intend to access the Website, as they may be modified without prior notice.
Some Website services, which may be accessible to all Internet users or exclusively to YOTEGUARDO clients, may be subject to specific conditions, regulations, and instructions that may replace, supplement, and/or modify these general terms and conditions. The USER must accept these specific conditions before using the corresponding service.
Accessing and/or using these services and content implies full and unconditional acceptance of the specific conditions published by YOTEGUARDO at the time of such access and/or use.
During the provision of Website services, the domain name under which these services are offered may change.
Therefore, the USER acknowledges and accepts this possibility, with the obligations accepted by both the USER and YOTEGUARDO remaining fully valid as established in this document.
3. GENERAL TERMS AND CONDITIONS FOR ONLINE PURCHASE AND SALE
3.1. General Information
These general terms and conditions for online sales are the only applicable ones and replace any prior general conditions in the event of a previous, express, and written cancellation.
Yoteguardo may occasionally modify certain sections of its general and specific purchase conditions. Therefore, we recommend reading them each time you visit the Yoteguardo website (hereinafter referred to as the "Portal").
These modifications take effect from the moment they are published online and cannot be applied to contracts concluded before that date. Each purchase made on this website is governed by the general conditions applicable at the time of placing the order. Consequently, once you place an order, you unreservedly accept our general terms and conditions of sale after having read them.
By accessing the Yoteguardo Portal, you agree to comply with the General Terms and Conditions as well as the Terms of Use outlined therein. Yoteguardo reserves the right to modify the prices of its products at any time. However, for online purchases, the price applicable to the consumer will always be the one displayed at the time of order placement, even if it undergoes modifications afterward.

3.2. Orders
Orders can only be placed through the purchase pages on our website and will be confirmed to you as a customer/buyer via email, SMS, or any other method that verifies their submission once they have been registered in our system.
The website https://yoteguardo.com is not a wholesale sales platform. Therefore, all purchases made through the website are specifically governed by retail commerce regulations and, preferentially, by Title III of Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws.
Yoteguardo reserves the right to reject certain purchase requests when the order volume or type does not comply with Yoteguardo's internal policies or the regulations set by product manufacturers. In such cases, the customer will be informed accordingly.
3.3. Product Information
Yoteguardo takes great care in providing accurate information regarding the essential characteristics of the products offered and sold, including manufacturer details, product specifications, and images provided by the manufacturers that best illustrate the items available for online sale.
All the information provided is within technical limits and complies with the highest market standards, always adhering to Spanish consumer protection regulations regarding pre-contractual information requirements. All products sold on the website are 100% original, and we work exclusively with official distributors.
3.4. Pricing and Payment Methods
3.4.1. Pricing
The prices charged to the customer for the products include applicable taxes. Shipping and delivery costs vary depending on the selected shipping method and will be added to the final purchase total, clearly itemized in the invoice.
3.4.2. Payment Methods
Customers can choose from the following payment methods:

All payments must be made in full at the time of purchase.
3.5. Product Availability
Due to the popularity, limited availability, or time-sensitive nature of some of our products, Yoteguardo may limit product availability for purchase. Therefore, Yoteguardo reserves the right to modify the available quantities at any time, even after an order has been placed.
Once an order is accepted and processed and payment has been received, it will be prepared for shipping within a maximum of 72 business hours, depending on stock availability. If a product is unavailable, Yoteguardo will issue a full refund as soon as possible.
Customers will be kept informed about order status updates via email, SMS, or any other notification method.
Customers may exercise their right of withdrawal, except in cases outlined in Article 103 of Royal Legislative Decree 1/2007, of November 16, which approves the General Law for the Defense of Consumers and Users.
3.6. Shipping and Delivery Times
Yoteguardo delivers orders to mainland Spain, the Balearic Islands, and the United States via our logistics partners. Shipments to the Canary Islands, Ceuta, and Melilla are currently unavailable.
- Customers may pick up their orders at the transport company’s local office if needed.
- Orders will be delivered to the specified address once payment is confirmed within 24 to 72 business hours (Monday to Friday, excluding holidays), depending on product stock and courier availability.
- Shipments to the United States may take between 7 and 14 business days, depending on the chosen shipping service and destination.
3.7. Delivery
Yoteguardo strives to ensure that the information on the website is accurate and up to date. Unless otherwise agreed, products will be delivered within the estimated timeframes from the payment date.
Delivery times are approximate and depend on product availability, courier schedules, and order placement timing. Customers will receive an estimated delivery date notification via SMS or email.
Delivery is considered completed once the courier delivers the product to the customer or an authorized third party, with a signed receipt confirmation. Customers are encouraged to check the condition of the items upon delivery and report any concerns before removing labels or opening the packaging.
For any inquiries, customers can contact Customer Support via the contact form on the Yoteguardo homepage or via email at soporte@yoteguardo.com, with a response time of up to 48 business hours.
The risk of loss or damage is transferred to the customer upon delivery. If the customer arranges alternative shipping through a courier not selected by Yoteguardo, the risk transfers to the customer once the goods are handed over to that courier.
3.8. Right of Withdrawal and Product Returns
Right of Withdrawal:
In accordance with Royal Legislative Decree 1/2007, which approves the General Law for the Defense of Consumers and Users, customers have 14 calendar days from the date they receive their order to withdraw from the purchase contract without justification or penalty.
However, returns will not be accepted if:
- The returned product does not match the item purchased.
- The original seal has been removed (except in cases of defective products).
- The product is not in perfect condition, has been opened, used, or damaged.
To exercise the right of withdrawal or cancel an order, customers must contact us via email at soporte@yoteguardo.com.
Returns
For product returns, yoteguardo will process the return only if the product remains sealed and unopened and does not fall under the exceptions listed in Article 103 of Royal Legislative Decree 1/2007, which regulates consumer protection laws in Spain. The customer must ship the purchased item back to yoteguardo's warehouse without undue delay and, in any case, within 14 calendar days from the date of delivery.
The returned product must be in perfect condition, including its original packaging, labels, and seals. Additionally, the customer must include the original purchase receipt, a simplified invoice, or a detailed purchase invoice.
According to Royal Legislative Decree 1/2007, the customer is responsible for covering the direct cost of returning the goods, except in cases where the product is defective or damaged.
Once yoteguardo physically receives the returned item and verifies that it meets the stated conditions, a refund will be issued for the product price only—excluding shipping fees or any additional costs. Refunds will be processed using the same payment method used for the original transaction.
Defective or Damaged Items
If a purchased product has a manufacturing defect, damage, or is in poor condition, the customer must contact yoteguardo via email at soporte@yoteguardo.com, attaching a photo of the damaged product for review. If the claim is validated, yoteguardo will proceed with the return process in accordance with Articles 114 and subsequent of Royal Legislative Decree 1/2007.
Refund for Cash on Delivery Orders
If the product was purchased using Cash on Delivery, the customer must provide their 20-digit bank account number to receive the refund, which will be credited within 5 to 8 business days.
Unless otherwise required by law or explicitly stated in this agreement, shipping fees are the responsibility of the customer.
PayPal Refunds
For orders paid via PayPal, refunds will be processed in accordance with PayPal's refund policies at www.paypal.com.
3.9. Warranties
yoteguardo guarantees that it has the legal authority to sell products via its website, yoteguardo.com, and that its online platform is technically equipped for e-commerce transactions. Every effort is made to ensure that the information displayed on the website is accurate and up-to-date.
Product specifications, colors, and designs may vary slightly depending on manufacturer updates.
All products purchased on yoteguardo.com are covered by a three (3) year warranty from the date of delivery, as required by applicable consumer protection laws.
This warranty does not cover defects caused by negligence, impact, improper use, or unauthorized manipulation.
If a purchased product exhibits a manufacturing defect or deterioration unrelated to misuse, the customer must report it to customer service at soporte@yoteguardo.com as soon as possible and within the legal warranty period of 3 years.
To use the warranty, the customer must provide the original purchase invoice or receipt.
If a warranty claim is validated, yoteguardo will proceed with either:
- The replacement of the defective product, or
- The refund of the purchase price, following applicable legal provisions.
In such cases, yoteguardo will cover all associated return costs and arrange for the product's shipment via an authorized carrier.
This warranty is independent of the right of withdrawal, as described in Section 3.8.
3.10. Secure Encryption Technology
To protect customer data, yoteguardo uses SSL (Secure Socket Layer) encryption, a widely recognized internet security standard for commercial transactions. Most web browsers display a lock icon to indicate an active SSL connection.
To prevent credit card fraud, yoteguardo may request additional documentation to verify the buyer's identity.
3.11. Tax-Free VAT Refunds for Non-EU Residents
This website is not affiliated with any Tax-Free refund services. However, travelers residing outside the European Union who purchase items through yoteguardo.com may be eligible for a VAT refund.

4. Disclaimer of Warranties and Liability
yoteguardo reserves the right to interrupt website access at any time and without prior notice due to technical, security, maintenance, or other operational reasons.
yoteguardo shall not be held responsible for service interruptions, delays, errors, or malfunctions beyond its control, including but not limited to:
- Third-party service failures (e.g., internet providers, hosting services).
- Government actions or public authority decisions.
- Cyberattacks, hacking, or security breaches.
- Natural disasters, power outages, or other force majeure events.
Under no circumstances shall yoteguardo be liable for direct, indirect, or consequential damages arising from such events.
Furthermore, yoteguardo is not responsible for user-generated content, including opinions, comments, or uploaded materials. Users are fully responsible for any legal consequences stemming from their actions on the platform.
Users must comply with all applicable laws regarding the use of website content and materials. These disclaimers do not apply where prohibited by law.
5.- ACCESS CONDITIONS
The provision of the service on the Website (simple navigation by the USER) by Yoteguardo is free of charge and does not require prior subscription or registration (except for access to areas reserved for registered users). However, if the USER wishes to receive periodic emails with new news about our products, they must first subscribe by accepting the sending of the “Newsletter” during the purchase process, which likewise does not entail any payment obligation.

6.- THIRD-PARTY LINKS (OUTGOING LINKS)
The Web access service may include technical linking devices, directories, and even search tools that allow the USER to access other Internet pages and websites (hereinafter, "Linked Sites").
In these cases, Yoteguardo acts as a service provider in accordance with Article 17 of Law 34/2002, of July 11, on Information Society Services and Electronic Commerce (hereinafter, the “LSSI”) and will only be responsible for the content and services provided on the Linked Sites to the extent that it has actual knowledge of their unlawfulness or that they may harm the rights of third parties and has not disabled the link with due diligence. If Yoteguardo considers that there is a linked website with illegal or inappropriate content, it may notify Yoteguardo at the contact address provided in the first section of these terms and conditions (soporte@yoteguardo.com).
To verify and identify the reported issue, it would be advisable to provide:
(a) The notifier’s details: name, address, phone number, and email address;
(b) A description of the facts revealing the unlawful or inappropriate nature of the Linked Site; and
(c) An express declaration that the information contained in the communication is accurate.
In no case does this communication entail an obligation to remove the corresponding link, nor does it imply, as stated in the LSSI, actual knowledge of the activities and/or content indicated by the notifier.
Under no circumstances should the existence of Linked Sites be understood as implying any agreement with their owners or managers, nor as a recommendation, promotion, or identification of Yoteguardo with the statements, content, or services provided.
Yoteguardo is not aware of the content and services of the linked websites and is therefore not responsible for any damages caused by the illegality, quality, outdated nature, unavailability, error, or uselessness of the content and/or services of the linked websites or for any other damage that is not directly attributable to Yoteguardo, except as provided in the aforementioned Article 17 of the LSSI. If the USER decides to visit and/or use any of the linked websites, they do so at their own risk and must take appropriate protective measures against viruses or other harmful elements.
7.- LINKS TO THE WEBSITE (INCOMING LINKS)
A USER who wishes to include links from their own websites to our Website must comply with the conditions detailed below, and ignorance of them does not exempt them from legal responsibilities:
(a) The link may only direct to the home page or main page of the Website and may not reproduce it in any way (inline links, deep-links, browser or border environment, copying of texts, graphics, etc.).

(d) Under no circumstances will it be expressed or implied on the linking page that Yoteguardo has granted consent for the inclusion of the link or that it otherwise endorses, collaborates with, verifies, or supervises the services of the linking website.

8.- INTELLECTUAL AND INDUSTRIAL PROPERTY
All content on the Website, including but not limited to texts, photographs, graphics, images, logos, icons, technology, software, links, domains, trademarks, and other audiovisual or sound content, as well as its graphic design and source codes, are the exclusive property of Yoteguardo or third parties whose rights Yoteguardo acknowledges, and are subject to intellectual and industrial property rights protected by national and international law.
Any use of any elements subject to industrial and intellectual property for any purpose, especially commercial, as well as their distribution, public communication, modification, alteration, transformation, or decompilation, is strictly prohibited unless expressly authorized in writing by the rights holder. Violating any of these rights may constitute a breach of these provisions and a criminal offense under Articles 270 et seq. of the Penal Code.
9.- ONLINE PURCHASE PROCESS

If the USER is under 16 years old, their personal data must be provided with the authorization of their legal representative.
